Coming to WA in 2012 ?? - Beware.
For all the members planning a trip over here in 2012 do yourself a favour and read the following link,

If someone was going to use a lease owners own machinery to rob their lease, it would make sense that, that somebody would know
where the lease owner was, while the robbing was going on and there was no chance of the lease owner turning up to spoil the fun.
That would point to a local or rather locals.

The fact is that u have to know were u r exactly and whether u have a legal right to detector befor u swing..u cannot pleed ignorance in court or to the local gold squad (police)..As one prospector found out, wrong place wrong time --lost his gold and a fine..
If the area is covered by a granted lease no matter what it is --it belongs to someone else..Get permission
If it is pending without underlying tenement holders then go for it.
This is the inference--It is written in black and white---"Knowingly" wont gell in legal terms.
Too be sure to be sure..

I will take and have done so ALL reasonable steps to make sure im not doing the wrong thing!! as I said to a ranger a while back "your Dept is charged under the legislation to sign the tracks that lead into flora /fauna areas" I had already made a special trip to Bendigo to work out on my maps where it was legal to go in this area. Its not my fault that all the deps were as helpful as teats on a bull! the official word was "ahh dont make a mess and fill yer holes and all should be good" can I have that in writing!! you can imagine the exodus to the back room when I asked that one

I was talking to a bloke at the Marble Bar Pub W.A. two weeks ago.
He went with his Son out to his lease to chase 7 Caravan’s set up on his lease.
Paper work in hand he said it was lucky they were big blokes as it got very heated in the eviction.
They then noticed they just moved on to the next lease set up.
He said they had had enough by this time and left them there.

The point is Murachu, that is not good enough in WA!
There most often won't be a proper lease setup, with posts defining corners.
You are just expected to know exactly where the lease is and exactly where you are, forget about signs, the onus is on you.
Now that can be bad enough for most that have been in the game a while
but do you think that your GPS is always right? I have had many things throw both of mine way out.
Now, Imagine ma and pa who just do a bit of casual detecting as they travel through
the state. Well to stay legal (If they are lucky) they need all the maps, GPS, etc
that we keen guys use, as well as being experts on tengraph.
It is a BS system that needs some rational though but hey, this is WA.

I heard one like that about 10 caravans out at 6 mile (sandstone WA) and the owner told them to ........well leave .With a bit more language.

Totally agree with you there, bloody real-estate owners are a curse to the prospector
and the future mineral wealth of any state in oz.....
All "EL" leases should be openned up to the humble detectorists/scratchers.

I think the Ma & Pa get a bad wrap for sure, its actually those ppl that take the time to get "20a's" and
yes they do add to the local bush econemy in most states gold areas, look at poor old Tarnagulla in vic,
Van park closed and town died in an instant.

The leasholder who has 3 leases out at the six mile, Sandstone hadn't done any work on any of his leases last time I was there. He complained about people going on his lease yet he doesn't work it. Plus I never saw any pegs of any description last time I was there.
If he is going to peg leases covering what has been a favourite detecting spot for hundreds, if not thousands of people since the 1970's he should expect those sort of problems. The only way out of it is to peg the leases clearly and put up signage that clearly states his boundaries.
Its my opinion places like that should be saved as designated fossicking areas and closed off to all leaseholders. If they aren't working it they should lose it. I informed the mines department about this bloke not having done any work on his leases since he got them but as usual nothing has been done.

exactely i was thinking the same, these famous prospecting locations such as the pearling ground,6 mile and specking patch should be free for all.That sort of thing really annoys me they get a lease and don't do anything with it ,like they enjoy telling people to go away and keeping it to themselves.excellent point Jim

Hang on a minute fellas...Just because u own a house and its vacant doesnt give u or anyone else to squat..
If u think that an area should be made into Common ground -then write to the minister and put your ideas and concerns forward..
A individual may own a series of leases and spend a small fortune working one--he can by law write of some of the expenditure against others.
There is absolitely nothing stopping u people peging your own patch of ground--tengraph ---use it.

fair enough oneday69 i just hate when people have famous patches such as the 6 mile and the pearling ground and expect people to stay far away. I know of people that have found ounces on ground they shouldn't have been on .I know a guy who found a 4 ounce piece on a private lease near cue.A lot of people do illegel prospecting and the owners don't give a s..t. I asked someone (a frequent prospector ) about tengraph he said 'WHAT,' he didn't even know what tengraph was.lack of education about this software means people give up and do what they want especially old prospectors not saying all old prospectors do.But Tengraph good tool if one knows how to use it.

The similie of having a vacant house doesn't hold anymore water than those saying about folks comparing going on a lease to invading a city blokes back yard, they are vastly different things. Even if you don't take the enormous difference in size into account.
As the law stands we cannot go anywhere on the six mile where gold is likely to be found but must only work areas outside the leases. And it isn't likely that any of us eastern staters would want to have a lease in WA. It is simply too hard to live here and have a lease over there that we can access only a few weeks or months a year. As for writing to the minister... writing to God would have about the same effect.
All I can say is I don't think it is right but at the same time I cannot see anyway of changing things the way they are.

We have to think about this it is not ''his,'' land it is the people of Australia's, our country isn't owned by one person or another (that's if nobody lives there that is) he is just borrowing it. If your not using it why be greedy why not share it with everyone we all pay taxes we should have a right to own land if we wont.BUT wait there are greedy people out there that can't share there land (sad people) with anyone else if your not using it why be greedy share it with your fellow Australians.

I am not saying i do (because i don't i follow the rules) but there is a lot of people that don't follow the rules and until it is easer to bust these people they will keep doing it i saw three caravans out when i was out that where on 'green land,' I don't know whether they where meant to be there or not.But if i want to report them i wouldn't because A)i don't know where to start B)it is to hard and i can't be bothered.so if your doing the wrong thing and i see you i probably wont care.It's to hard i don't even know where to report it.

It is my information that 2/3rds of WA is auriferous, that is, gold can be found on it. It is also my information that ALL of this land, and more is pegged in one way or another by big companies. Under this you can then find the actual working mines owned by large companies then the land pegged by Real Estaters and those individuals who have more than one mining lease. In fact there is no known gold producing land left in WA that is not covered, or about to be covered (pending) by leases. With this the case how are those who wish to do a bit of casual prospecting going to go about it? The draconian mining laws of WA have no place in a democracy such as Australia, yet they persist. Why do they persist? Because good men have not done enough. In fact against the might of the big companies and an uncaring state government very little CAN be done.
Victoria, on the other hand has much more just laws for the prospector, we can go on a EL at any time and there are very few small prospectors in Vic.
