Yes this gold was recovered with a metal detector, after a bulldozer had removed a metre or so.
Detectorists would never have found it in its natural state.

You can be sure that magnetics have fired up a tribute agreement.to enable a cut of the action,bite of the cherry,share of the action, etc etc.

The bitter part of this story is that the original patch was found by "Eastern Staters" that never had a Sect 40e permit to be on that ground. They were tracked and sprung by the pastoralist and a local guy and finally caught red-handed on their third visit. They were prosecuted for gold stealing. The said pastoralists and his mate are now getting the gold from the patch.
Moral of the story, "Get a permit, get the surface gold, keep yer gob shut, ONLY THEN should you do a deal with the company".
Second moral? "Don't trust anyone, especially "the locals"!

How do you legally "keep you gob shut"? An obligation of the Section 40E Permit System is that:
"The permit holder must advise the license holder and the department of any mineral recovered within 14 days of expiry, cancellation or surrender of the permit."
Having done that, it would be too late to do deals, wouldn't it?

I was not aware that a pastoralist had any claim to gold on his lease unless he had a gold mining/prospecting lease of some kind over the ground?? Right or wrong?? Been a while since I read WA prospecting laws
After a quick look I was not able to find much info in ref to Pastoral Leases and fossicking under a miners right in WA.

Anybody with a WA miners right has a claim to gold they have found, a pastoralist is no different and would also need a WA miners right to prospect on his pastoral lease.
Without a WA miners right you (individuals) cannot even apply for a gold lease or a 40e permit, I don't know what the mining companys have in the way of a WA miners right.
The pastoralist were discussing here has done a deal with the mining company, tribute agreement (like share farming) to do what he is doing.
