gold prospecting in NSW

was just searching sites for gold prospecting possibilities and found this info, is it true or BS?

Isn't that 50g restriction in 48 hours in relation to State Forest Legislation only? I've never heard of NSW limitations outside of the State Forest Fossicking Act.

Nope not state forest 50 grams anywhere

prescribed amount, in relation to material, means:
(a) 10 kilograms of mineral-bearing material (other than the material referred to in
paragraphs (b)–(e)), or
(b) 5 kilograms of minerals (other than gold or gemstones), or
(c) 50 grams of gold (except where found as nuggets of 10 grams or greater), or
(d) 5 nuggets of 10 grams or greater of gold, or
(e) 100 grams of gemstones.

Kissing a 10kg nugget and then throwing it back (wouldn't want to imagine it).

I wonder what would happen in that situation, if everything had been done legaly and say a ranger for some reason had been watching you unearth the target And if you found something like that they expect you to wait 48 hrs before finding out if there is anything else there

There is a key line there though that says:

"5 nuggets of 10 grams or greater of gold"

This means you can carry 5 nuggets of 1kg each if you wish ;P

Just remember one thing!
In law the burden of proof lies with the one making the claim.
In other words they (Barry O'farrel or ATO ) has to prove beyond a resonable doubt that you found more than permitted in the 48 hour time
so if any government official ever asks you anything don't tell them any thing because any thing you do or say can be used against you in court of law.
