Getting 'hustled' off an 'alleged lease' ....
Noticed on another thread .....
Various comments about 'so-called' trespass on other's leases/properties ??
Hasn't happened to me [yet ?] but I have a 'strategy' in place to deal with it, if I wasn't really confident about my location.
Without creating an antagonistic encounter with your 'confronter' ....
(Unless you fear it may be " BIG BUBBA" and his mates ... just escaped from the local prison laundry detail ??
In which case ..... tail 'twixt legs and 'scarcify' yourself !!!)
If you don't have a GPS, just pull out your sunnies case and wing it ........
Generally, the aggressive ones' may not be in the right .... as mentioned, mostly the genuine lease-holder will be reasonable,
provided you're not confrontational or aggressive yourself.....
Of course, all this supposes that you have, at least, reasonably legal grounds for being there in the first place.
Discretion is ALWAYS the better part of valour [or even just being right] ....... more so if "Big Bubba" is involved !!
Just my thoughts ....... Pedro

- simply, as others have suggested, ask for their credentials/authority to direct you to leave.
AND .... NOTE THEIR VEHICLE REGISTRATION NUMBER [and make/colour if you can,] - WHILST PULLING OUT YOUR GPS AND MAKING A MARK OF YOUR CURRENT LOCATION !!
- Explain to them what you are doing ....... AND WHY !!!
- "You may be right, mate ....we'll just confirm this position with the local authorities.......my apologies if you are genuine .......
if you're not .... WE'LL BE BACK WITH OUR AUTHORITY - and staying !!!

Re: Getting 'hustled' off an 'alleged lease' ....
If you have done your research properly you will already know if you are able to legally detect an area.
You will already know if it is covered by a mining lease or not and you would have obtained the necessary permission/permits. You would be armed with the necessary paperwork and contacts to show to anybody challenging your right to be in a particular area. If you don't and you haven't then you should not be there.

thank you, at last people are starting to get the message. Come over to WA by all means but do your homework. Only detect for gold where you can legally do so and then you have no worries whatsoever.

Re: Getting 'hustled' off an 'alleged lease' ....
I agree with Adrian and Mel.
But also, how do members here deal with being aggressively and even non aggressively being told to remove themselves from an area they have all legal right and permission to detect?

Re: Getting 'hustled' off an 'alleged lease' ....
I hear where you are coming from..........all I can suggest is that you have your paperwork on your person at all times (ie letters of permission from the leaseholder, maps etc) and show them to people who confront you. If this does not work maybe someone out there can offer a better suggestion.

Gday
In some cases it is smarter just to move on, in a situation where you have been threatened by a person or persons, you simply get all the information you can and then leave, take the matter up with the police and mines department or whatever.
There are goldfield bullies no question about that, I wont go into details but you need to realise that in some cases you are on their turf and they know the place better than you, if you remain in the area after you have been threatened then you are simply prevoking them, quite simply there are areas that hold an interest for organised groups and they will move you on if you resist their initial threats.
Dont be a hero and just go somewhere else, there are many and varied ways of dealing with these types through the right channels, as someone else has pointed out the onus is on you to know where you are and for you to be there legitimately, if you have strayed into somewhere that you shouldnt be and are asked to leave, and you know you not supposed to be there so just make you appologise and move on, its the safest way to deal with it.
I will usually stand up for my rights and suss the person out as best I can, and ask as many questions as you need to, but there is a point where you have to consider your safety, whether you are on your own or there is a group of you, and you have to realise that in this day and age its no longer a rarity for people to get assaulted but its common place and some of these types think that they are above the law and simply dont care about the consequences, what hope have you got in this situation if you are miles from anywhere and there no one to see whats going on?.
You can mimimise the chances of these types of incidences occuring by doing your homework and having the necessary paperwork to cover your bum, apart from all that if you are in an area legally you can wander about the place and and not have to look over your shoulder and worry about other people its a far more enjoyable way to do things, if you are just sussing out an area that you may have an interest in for a future trip then follow the rules and do just that, look but dont touch, if you see anybody about stop and talk to them and find out what the situation is of the area, most leasholders will be quick to tell you what is theirs and what is not, and very often will point you in the direction of ground that is available, so sometimes the exercise can be worthwhile, its through this method that in some cases I have been given permission by the leasholder to be in his area as sometimes if they are working the deep stuff they will not be that interested in the alluvial, and so will just usually request that you tell them where you find any gold in return for you being there, so they can have a look for its source.
As long as you are doing the right thing you have very little to worry about and the experience will remain a pleasant on for you.
cheers

better to team up
It is sad to hear that one prospector is always trying to out do the other instead of getting to have a chat and share the exchange and possible support of one another. I have been driven away before by a chap in the Kimberley region and then found many others who actually worked with me and we produced more gold together and shared the profits. The knowledge they shared has put me on a positive path and I know that one detector as a solo operator is not the way to produce gold.Selfish and greedy people claiming that they own such a vast area need to have a reality check. One more point - the most succesful prospectors I have ever met actually took me to areas where one hole produce over 2 ounces and then within 5 meters I found another 20 grms and all they said was well done.Thats sharing!!

Getting chased off someone else's lease
Hey Mel ,
Your first post implies that it is only people from other states that do the wrong thing and not people from W.A. , that is a ridiculous statement .

Re: Getting 'hustled' off an 'alleged lease' ....
My experience is that a lot of "Out Of Towner's" go to WA and detect illegally and that those telling them to bugger off are locals who also have no right to be there but because they have found gold in a particular area they just don't want anybody else finding what they think is theirs because they reckon they found the patch first.... even if the patch covers 600 sq miles or so!!
I will admit though that if you have got the necesssary written permits and permission to detect an area and it is a good gold producer, and then someone without permits etc rolls in, in a squeeky clean Pajero with mum and the kids and does a couple of sweeps with his new Minelab and walks out with a 20kg nugg; then yeah, that can p... you off a bit.

Re: Getting 'hustled' off an 'alleged lease' ....
Gday
Its not just out of towners that do the damage on the WA goldfields, we have some of our own who have trouble filling in holes and remembering to take the rubbish with them etc etc, as a matter of fact there is an article in the latest GGT magazine from a WA leaseholder talking about exactly the same thing, people going where they are not supposed to be and not caring about who has paid for the right to be there.
The issues are the same now as they have been for many years, and it will be because of a few people that the rest of us will eventually miss out on going to some of these places, it seems to be the way everything is going and its always the same, one or two fools wreck it all for everyone else.
These issues are not confined only to WA , the same thing happens everywhere there is gold, the greed and the total lack of respect for others will eventually cause enough rules and regulations to be put in place that it will all become too hard for most people and it wont be worth the effort or the cost.
cheers

Re: Getting 'hustled' off an 'alleged lease' ....
rjcootes.................my reply was actually answering a question "is it worth coming to WA" and yes you are right...local WA prospectors are just as bad (probably worse) at illegal detecting.
