Re: Found while taking a stroll
WOW!!! My sister and hubby live in Bendigo... i'm heading up there tomorrow and staying for a few days, using their place as a base while doing a bit of detecting
Wondering now whether I need to take all my gear..might just take my boots and start kicking over a few rocks
What a fantastic find...good on 'em

Re: Found while taking a stroll
The 8 year old daughter found it. Children don't have to have a miners right as far as I am aware.

Re: Found while taking a stroll
So long as at least one of the parents holds a Miners Right.
The Gov has no claim over it because it is not deemed to be treasure trove.....I am sure someone will make a grab for it though......That is one find I would have kept quiet about.

From Parks Victoria;
Children under 18 years of age do not need a Miner’s Right if accompanied by an adult Miner’s Right holder if prospecting.
But they were not prospecting?

Re: Found while taking a stroll
G'day gents
Although I respect & abide by the laws set down by our governing officials, the law of stumbling over a natural earth made mineral/precious metal find by anyone, should belong to the finder & not the state. The law of government stepping in the moment a person accidentally stumbles over a precious/valuable mineral, treasure trove or artefact find by accident, should be rewarded & encouraged with incentive (some form of monetary compensation to the finder) so that the Item in question found, stays in our museums for all to see & not end up being sold on the black market, physically altered in any manner in order to have it sold off as something else, or ending up in the hands of some private collection, never to be seen again by the general public. The threat of major fines/jail terms for accidental treasure trove finds as they stand, do little from turning innocent people/finder/s into criminals, by not handing the precious find on to relevant authorities without reward.
My opinion & under the laws set down on treasure trove finds of significant importance, should be rewarded & credit given to where credit is due, so that all parties concerned, end up satisfied with the out come & the valuable find stays here in our museums, in Australia. After all, its not everyday a part of treasure trove history is found.
Cheers Kon.

Re: Found while taking a stroll
Never mind the law Kon. Finders keepers. It would take a dead set mongrel to try and deprive this family from doing what so ever they wished to do with this nugget.
Have you got a dog Kon? If you have you better start taking it for walks now that you live in Bendigo. If you don't have a dog, then you best get one.

Re: Found while taking a stroll
And yet it happens Reg. Maybe not often, but knowing the government (like an insurance company) if the payout or valuable find was big enough, they'll search for any technicality/excuse, to find you in breach of the law, in order to confiscate, or in the case of insurance, not pay you out.
And yes we do have a family pet dog (Jack Russel terrier) of which my daughter is currently looking after, but more hope of him taking me for a walk & not I. Snappy little fella & a born killer I tell ya. A mind of their own.

Re: Found while taking a stroll
With a accidental find like this you would like to think that if the finders didn't have a miners right then common sense would prevail and the authorities would issue the finder with a backdated miners right.

Re: Found while taking a stroll
Is this find genuine, there are three different photos accompanying different stories about this find?
